Review of the T&DCA Special General Meeting
Ontario Sports Alliance Building

Topics for Discussion:

1. Presentation of proposals that were accepted in the motion passed by the general membership in the year 2001 and 2002

2. Constitution changes and amendments

Not much was accomplished at this meeting. Representation from most clubs again was very poor. Many of the proposals put forth by Board Member George Williams were defered to a committee for further review. Including each of the following issues:

Proposals for Revision, Addition & Changes to the T&D Constitution & By-Laws.

As per the motion's that were passed at the General meetings of both year 2000 & 2001. This proposal is to be discussed, changed and voted upon at the Special General Meeting Scheduled for March 3rd 2002.


RECOMMENDATIONS TO ARTICLE 4 TABLED - AGM 2000 & 2001

RECOMMENDED CHANGES TO ARTICLE 4 - ELECTION OF OFFICERS - Section b

  1. The positions of the President, Vice President, Secretary, Treasurer and Junior Coordinator, should be elected from among the twelve (12) previously appointed Board Members, by a process of election by the General Membership. These five (5) elected officers of the Board of Governors, become the executive committee, who is responsible for carrying out the responsibilities of the portfolios they hold,
    OR
    All twelve appointees to the board as defined above, may be nominated and elected from the floor by the General Membership.
  2. No more than one person per club should be represented on the Board. In the event there is more than one nominee representing a single club, the person with the most number of votes will be appointed to the board.
  3. The board should consist of a representative from each division in the league, including the juniors.
  4. The Secretary should be given and honorarium of $1200 per annum to be approved by all members.

RECOMMENDED ADDITION TO ARTICLE 4 - DURATION OF OFFICE - Section e

The Term of Office per portfolio, of a member of the Board of Governors, including the executive office bearers, may not exceed a period of two (2) consecutive years.

Recommended addition to Article 4 - Section (a) Election of Officers.

In the event of a tie vote, another ballot shall be held between those involved in the tie and after the second vote the President shall have the casting vote.

This may become redundant if executives are nominated and elected by the general membership.

2. Section 6- REFUSAL TO PARTICIPATE

(a.) Refusal to participate in schedule of games or unilateral withdrawal of a club or team shall be considered as having withdrawn from the Association. All fees paid to the Association by a club or team withdrawing from the schedule shall remain the undisputed property of the Association.

This needs to be changed to include:

A club or team's refusal to participate in a scheduled game, must be substantiated by a reasonable excuse addressed to the board in writing 2 weeks prior to the game. If not, the club or the team will be considered in breach and maybe fined an amount to be determined by the Board and Could lose up to a maximum of 12 points from the standing.

3. Players code of conduct Section 8. UNREGISTERED and UNRELEASED PLAYERS

Changes to the 2nd Para:
The unregistered or unreleased player himself will be subject to a minimum of one (1) month's suspension upto a maximum of three (3) months and a fine of $150 and the club maybe subject to a maximum of $150. In the event a player defaults on payment of fine the Club is responsible for the fine. The fine is to be paid within 14 days of the decision of the board of governors.

The only proposal that was voted on was the time within which a protest could be made. This motion passed. This will eliminate clubs protesting matches in September that took place in May:

1. Section 17 of the Constitution - PROTEST and COMPLAINTS section (a)

(a.) All matters of protest and complaint which members may wish to bring before the Board of Governors shall be in writing, and, in the case of clubs or organizations, shall be signed by the President or Secretary of the protesting or complaining member club or organization. Full details shall be set forth showing the nature of the protest or complaint, the name and addresses of witnesses or other persons who have a personal knowledge of the matter brought forward and are willing and able to give evidence, either personally or in writing, before the Board of Governors.

Addition TO SECTION (a)
1. All matter of protest and complaints must be made in writing by fax or email within 14 days of an incident to the board occurs prior to August 30th. Where an incident occurs after August 30th compliant has to be made within 48 hours of occurrence and the board of governors is to action it within 48 hours of receipt of complaint . The complaint has to be received in writing, fax or by email.

Questions were asked of the board concerning their rejection of the proposals made by George Williams, however they could not provide a concensus view on what was good and what was wrong with the proposals.

Other issues arose after the completion of the constitution review. Including concern over lost or ignored correspondence, the restructuring of the Premier Division and the addition of a Canada Under-23 team. The process of promotion and demotion being a board decision based on various criteria set out in the constitution also brought about questioning from some members. The board refused to explain their decision making process over why one club avoided demotion or was selected for promotion or over another club.
