The OCA Board regrets that it has decided to involve the courts to protect its interest to resolve compounding issues with CC. The OCA hands were forced by CC, with its ongoing and unreasonable interferences in OCA operations and a totally draconian resolution passed by CC against OCA, at their recent SAGM.This resolution called for OCA to nullify its SAGM and AGM within 30 days or be expelled from CC.
As a result, with no options left, on Thursday September 30, 2010, The OCA initiated Legal proceedings against CC .
The subject matters included in the CC motion, requires an OCA SAGM to address. The OCA asked CC to extend the October 04 deadline, so that they can give appropriate notice of six (6) weeks to its Board, as required by the OCA constitution. The earliest window to conduct the meeting was October 24, 2010, which the OCA proceeded to schedule..
The President of CC denied the request, instead two of the Provincial Directors, Vimal Hardat and Chris James responded, asking Mr. Kendall to accept the motion or……. With the denial of this request, the OCA was placed in an unenviable position to file this court injunction, and hopefully bring an end to interferences by the President of CC and his executive in OCA affairs. It was very clear that CC had taken the position to dictate to the OCA to comply with what they want, and not discuss or negotiate.
A letter from the OCA Lawyers was sent asking for an extension, which met similar fate.
OCA Board regrets that we had to initiate legal proceedings against CC. However this is the only avenue left for us to protect our interests and seek justice.
